A case of mistaken identity has resulted in a costly legal lesson for a New York-based project manager. When Kim Kardashian shared an image on Instagram in early 2024 intended to highlight a Texas death row inmate named Ivan Cantu, her social media team mistakenly posted a photo of a different Ivan Cantu—a living, law-abiding professional working in Westchester. Though the error was corrected quickly, the damage to the innocent man's reputation prompted legal action the following year.
The New York Cantu filed a civil lawsuit against Kardashian in Los Angeles, arguing that the misidentification exposed him to online harassment and damaged his professional standing. According to Fast Company, his complaint cited multiple grounds including defamation, invasion of privacy, and intentional infliction of emotional distress. However, the case faced an immediate legal obstacle: California's anti-SLAPP (strategic lawsuit against public participation) laws, which are designed to protect free speech by dismissing frivolous litigation early.
Last year, a judge granted Kardashian's motion to dismiss the lawsuit under anti-SLAPP protections. The court determined that despite the financial disparity between the parties—Kardashian's billionaire status versus Cantu's self-described modest means—the plaintiff remained responsible for the defendant's legal fees under California law. As the judge noted, income differences are legally irrelevant to fee calculations in anti-SLAPP cases.
Cantu now faces a bill of approximately $167,473 in legal fees, though the court partially reduced one component from $57,107 to $38,261. The case underscores a significant risk for individuals pursuing litigation against well-resourced defendants: the potential financial consequences of losing, particularly in jurisdictions with strong anti-SLAPP statutes. For Dallas-area business professionals, the ruling serves as a cautionary reminder about the costs of pursuing civil claims that courts deem frivolous or speech-protective.
